These Terms of Service (“Terms”) establish the conditions under which Hoop to the Rhythm® (“we,” “us,” or “our”) provides 1:1 virtual hoop dance fitness instruction. By purchasing, booking, or participating in a session, you (“Client,” “you,” or “your”) agree to these Terms, subject to applicable law and any rights that cannot legally be waived.
Hoop to the Rhythm® services are exclusively available to individuals aged 18 or older. By booking, you confirm that you are at least 18 years old and legally able to enter into this agreement.
Individuals under 18 may not purchase, book, or participate in our services. We reserve the right to cancel a booking if the eligibility requirements are not met, subject to applicable legal obligations.
Hoop to the Rhythm® provides individual virtual hoop dance fitness instruction, movement education, hoop technique, coordination, rhythm, and fitness-oriented practice.
Services are delivered remotely through a designated video-conferencing platform. Offerings may include single private sessions and prepaid multi-session packages.
The booking page or purchase confirmation will identify the applicable service, session duration, price, and number of sessions included.
Instruction may be adapted to your stated goals, experience, and abilities. We do not guarantee particular fitness outcomes, physical changes, or skill-development results.
Full payment is due at the time of purchase unless a different arrangement is expressly agreed to in writing.
Your booking is confirmed when payment is successfully processed and confirmation is issued through the online booking platform or by Hoop to the Rhythm®.
You are responsible for reviewing the service description, price, appointment time, package details, and applicable policies before completing your purchase.
You must provide accurate contact information and monitor your email and booking account for appointment confirmations and service-related communications.
All sales are final and nonrefundable to the fullest extent permitted by law.
Except where a refund or other remedy is required by law or expressly provided in these Terms, we do not provide refunds for changes of mind, personal scheduling conflicts, missed appointments, failure to use purchased sessions, or failure to achieve a desired result.
This policy does not waive applicable statutory cancellation rights, remedies for services not delivered as agreed, or any other consumer rights that cannot legally be waived.
If Hoop to the Rhythm® cancels a paid session and cannot reasonably provide a replacement appointment, we will provide an appropriate remedy as required by law and the circumstances.
Certain prepaid dance and fitness instruction agreements may be subject to Ohio Revised Code Chapter 1345, including the Prepaid Entertainment Contracts Act. Where applicable, statutory cancellation rights, required contract disclosures, and refund obligations take precedence over this general no-refund policy.
Any cancellation notice required by law will be provided in the legally prescribed form and manner. Nothing in these Terms is intended to restrict a right that applicable law makes non-waivable.
All sessions included in a prepaid multi-session package must be booked and completed within three calendar months of the purchase date, subject to applicable law and the exceptions below.
The three-month period begins on the purchase date shown in your receipt or confirmation.
You are responsible for scheduling your sessions promptly through the online booking platform.
Sessions are subject to availability and are confirmed only when the booking platform or instructor confirms them.
Clients are encouraged to book all package sessions early to secure preferred appointment times.
Unused sessions may expire after the three-month deadline without a refund or cash value, to the extent permitted by law.
Extensions may be granted when required by law, when our availability prevents timely completion, or when approved by us in writing.
Reasonable accommodation requests and other circumstances protected by applicable law will be considered as required.
We are not entitled to rely on the deadline to avoid our obligations when our own actions have prevented timely completion of the purchased services.
Single-session purchases: The three-month package deadline does not apply to individual single-session purchases. Single sessions remain subject to their confirmed appointment time and the rescheduling policy below.
At least 24 hours' notice before the scheduled start time is required to request a reschedule without a late-rescheduling penalty.
Rescheduling with sufficient notice: One reschedule per appointment is permitted with at least 24 hours' notice, subject to availability.
Late cancellations: Requests made less than 24 hours before the appointment may be treated as late cancellations, and the session may be counted as used, subject to applicable law and any exception approved by us.
No-shows: Failure to attend a confirmed session without prior communication may result in the session being counted as used, subject to applicable law and exceptional circumstances.
Late arrivals: Sessions ordinarily end at the scheduled time. Late arrival does not automatically entitle the Client to additional time.
Rebooked package sessions: Rescheduled sessions remain subject to the original three-month package deadline unless an extension is approved or legally required.
All rescheduling requests must be submitted through [Booking Platform or Rescheduling Email]. A request is not approved until confirmation has been provided.
We may consider emergencies, significant technical problems, accessibility needs, and other reasonable circumstances individually. Exceptions are not guaranteed, but applicable legal obligations will be honored.
If we need to cancel or reschedule a session, we will notify you as soon as reasonably possible and offer an alternative appointment.
If a technical failure on our side prevents meaningful delivery of a session, we will offer a replacement appointment or another appropriate remedy.
You are responsible for maintaining a suitable internet connection, compatible device, and functioning audio or video equipment as needed.
If a Client-side technical issue prevents participation, the session may be treated as used depending on the circumstances, subject to applicable law.
We cannot guarantee uninterrupted operation of third-party platforms. However, technical interruptions do not eliminate our obligations regarding services that cannot be delivered.
Hoop to the Rhythm® provides fitness-oriented instruction and movement education. Our services are not medical care and do not constitute medical advice, diagnosis, treatment, physical therapy, rehabilitation, or services provided by a licensed healthcare professional unless expressly stated otherwise.
We do not diagnose or treat medical conditions, prescribe medication, or guarantee injury prevention, weight loss, physical changes, or any particular health or fitness outcome.
Individual results vary according to experience, consistency, physical condition, effort, and other factors.
You are responsible for determining whether participation is appropriate for you. If you have concerns about your ability to exercise safely, consult a qualified healthcare professional before participating.
Hoop dance fitness involves physical movement and may include spinning, turning, stepping, repetitive movement, coordination exercises, and use of a hula hoop or weighted hoop.
Participation carries inherent risks, including muscle soreness, strains, sprains, falls, loss of balance, collisions with objects, dizziness, and aggravation of existing injuries or conditions.
You voluntarily choose to participate and acknowledge the ordinary, inherent risks of physical activity to the extent permitted by law.
You agree to:
Maintain a clear practice area free of avoidable hazards, including furniture, pets, loose objects, stairs, and fragile items.
Use equipment appropriate for your space, experience, and ability.
Wear appropriate clothing and footwear.
Avoid slippery surfaces and unsafe surroundings.
Follow reasonable safety instructions and work within your abilities.
Avoid participating while impaired by alcohol or substances that affect coordination or judgment.
Stop exercising if you experience significant pain, dizziness, chest pain, unusual shortness of breath, or other concerning symptoms, and seek appropriate medical attention when necessary.
Virtual instruction limits our ability to assess your physical condition, equipment, surroundings, and every movement you perform. You remain responsible for your practice environment and personal exercise decisions.
Nothing in these Terms releases liability that cannot lawfully be waived or limited.
You are responsible for having the equipment, internet connection, device, and practice space reasonably necessary for your session.
Demonstrations and movement guidance are provided remotely. You acknowledge that virtual instruction has limitations and cannot guarantee that every exercise will be appropriate for every individual.
You may pause, modify, or stop an exercise if you feel uncomfortable or unsafe.
Hoop to the Rhythm® does not ordinarily record private virtual sessions.
Neither party may record, photograph, livestream, or publicly distribute an identifiable private session without prior permission and any consent required by law.
Personal information will be handled in accordance with the Hoop to the Rhythm® Privacy Policy. Third-party booking, payment, email, and video-conferencing providers may process information under their own terms and privacy policies.
You are responsible for protecting your account credentials and meeting links and choosing an appropriate private environment for participation.
The Hoop to the Rhythm® name, branding, original instructional materials, and original content are owned by us or used with permission, as applicable.
Materials supplied with your purchase are for your personal, noncommercial use unless a separate written license states otherwise.
You may not copy, reproduce, distribute, sell, publish, record, or commercially exploit proprietary materials without prior written permission.
Nothing in these Terms transfers ownership of our intellectual property to you.
Clients must communicate respectfully and maintain appropriate professional boundaries.
Threatening, abusive, discriminatory, harassing, unlawful, or repeatedly disruptive behavior may result in a session being paused or ended, or future bookings being declined.
Any termination of services and treatment of unused prepaid sessions will comply with applicable law and the circumstances. Nothing in this section authorizes an unlawful forfeiture of payment.
To the fullest extent permitted by applicable law, Hoop to the Rhythm® will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from participation in its services.
Where permitted by law, our aggregate liability relating to a particular purchase will not exceed the amount paid for the specific service giving rise to the claim.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, or other liability that cannot legally be excluded or limited. Liability for injury caused by negligence is not excluded where such exclusion is prohibited by law.
To the extent permitted by law, you are responsible for third-party claims arising directly from your unlawful conduct, intentional misconduct, or material breach of these Terms.
You are not required to indemnify us for our own negligence, willful misconduct, or violations of law where such indemnification is prohibited.
Neither party will be responsible for delays caused by circumstances reasonably beyond their control, including severe weather, emergencies, government restrictions, or major internet or platform outages, to the extent permitted by law.
The affected party should provide notice as soon as reasonably practical. We will make reasonable efforts to reschedule or provide another appropriate remedy.
This provision does not remove rights that cannot legally be waived or excuse obligations regarding services that cannot be delivered.
If you have a concern about a session, booking, payment, or other service, contact us at [Business Email Address] and include relevant booking details.
We encourage good-faith efforts to resolve concerns informally. Nothing in these Terms prevents either party from exercising statutory rights, contacting a regulator, or bringing a claim where legally permitted.
These Terms are governed by the laws of the State of Ohio, subject to applicable federal law and mandatory consumer-protection requirements.
Any dispute will be handled by a court or other forum with proper jurisdiction. Nothing in these Terms waives a mandatory consumer right or requires a Client to use an unlawful forum.
We may update these Terms for future purchases or services. The version presented at the time of purchase will govern that transaction, subject to applicable law.
We will not use a later revision to retroactively remove rights that have already accrued or cannot lawfully be waived.
If any provision is found unenforceable, it will be limited or severed only to the extent necessary, and the remaining provisions will continue in effect where lawful.
These Terms, the applicable service description, purchase confirmation, Privacy Policy, and any separate legally required cancellation notice or acknowledgment form constitute the agreement governing the services, subject to applicable law.
By completing the booking and acceptance process, you acknowledge that:
You are at least 18 years old.
You have had the opportunity to review these Terms and the Privacy Policy.
You understand the payment, refund, and 24-hour rescheduling policies.
You understand the three-month booking and completion requirement for packages.
You understand that hoop dance fitness involves physical activity and inherent risks.
You understand that the services are fitness-oriented and are not medical treatment.
